Town of Somerset resolution calling for repeal of the NY SAFE act

SUPPORT OF SECOND AMENDMENT

Supervisor Engert stated that the Councilmen and he have received several comments from residents regarding the NY SAFE Act and how it infringes on our rights. He read a letter from Councilman Wayner for the record, which stated (in part) that the actions of Governor Cuomo “to promote and sign into law the ill­ conceived and mis­named NYS SAFE Act, in direct contradiction to the United Stated Constitution, is all the impetus required for me to oppose his irresponsible actions”. The letter further stated “for us to  stand by silently and allow this or any government to trample underfoot our Constitutional rights would be in direct contradiction to the very spirit and purpose of their sacrifices” (our servicemen and women) and urged the Board to adopt the proposed resolution requesting repeal of this unconstitutional and dangerous law.

On a motion of Councilman Dewart, seconded by Councilman Alt, the following resolution was ADOPTED

WHEREAS, the right of the people to keep and bear arms is guaranteed as an individual right under the second amendment to the United States Constitution and under the Constitution of the State of New York, and

WHEREAS, the right of the people to keep and bear arms for defense of life, liberty and property is regarded as an inalienable right by the people of the Town of Somerset, New York, and

WHEREAS, the people of the Town of Somerset, New York derive economic benefit from all safe forms of firearms recreation, hunting, and shooting conducted within Somerset using all types of firearms allowable under the United States Constitution and the Constitution of the State of New York, and

WHEREAS, the Town of Somerset Town Board being elected to represent the people of Somerset and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and

WHEREAS, the New York State Assembly and the New York State Senate being elected by the people of the State of New York and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and

WHEREAS, legislation hastily passed by the New York Assembly and Senate and signed into law by Governor Cuomo without public hearings, infringes on the Right to Keep and Bear Arms and would ban the possession and use of firearms now employed by individual citizens of the Town of Somerset for defense of life, liberty and property and would ban the possession and use of firearms now employed for safe forms of firearms recreation, hunting and shooting conducted within the Town of Somerset, New York, and

WHEREAS, the Town of Somerset Town Board believes there are many other less intrusive means available other than rash, confusing and inarticulately drafted firearms laws that would effectively control, manage and reduce violence in our society such as mental health reforms, anti­bullying programs for schools, enforcement of existing firearms laws to the fullest extent possible and proper psychological counseling for those in need or who request it.

NOW, THEREFORE, IT IS HEREBY RESOLVED that the Town of Somerset Town Board does call upon our NYS Legislature to repeal the NY SAFE ACT and further hereby oppose the enactment of any legislation that would infringe upon the Right of the People to keep and bear arms and consider such laws to be unconstitutional, unnecessary and beyond lawful legislative authority granted to our State representatives, as there is no documented correlation between gun control measures and crime reduction.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to President Barack Obama, Vice President Joseph Biden, Senator Charles Schumer, Senator Kirsten Gillibrand, Congressman Chris Collins, Governor Andrew Cuomo, Senator George Maziarz and Assemblywoman Jane Corwin.

WHEREAS, the right of the People to Keep and Bear Arms is guaranteed as an individual right under the Second Amendment to the United States Constitution and under the Constitution of the State of New York;

WHEREAS, the right of the People to Keep and Bear Arms for defense of Life, Liberty, and Property is regarded as an Inalienable right by the People of the Town of Candor, Tioga County, New York;

WHEREAS, the People of the Town of Candor, Tioga County, New York, derive economic benefit from all safe forms of firearms recreation, hunting and shooting conducted within Candor using all types of firearms allowable under the United States Constitution and the Constitution of the State of New York;

WHEREAS,the Town of Candor Board, being elected to represent the People of Candor and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York;

RESOLUTION TO AMEND NYS SAFE ACT

Resolution to Repeal the New York Secure Ammunition and Firearms (S.A.F.E.) Act

WHEREAS,    We, the Town Board for The Town of Wales, Erie County in the State of New York, as representatives of our residents and as individuals, object to the infringement of the rights preserved to the citizenry by the 2nd Amendment of the Constitution of the United States of America by the governing bodies of New York State, and

WHEREAS,    On Monday January 14th, 2013 the rights of our citizens as protected  under the second Amendment of our Constitution were infringed upon without due process, and

WHEREAS,    A Gun control law (S.2230) known as New York Secure Ammunition and Firearms (S.A.F.E.) Act, was, without just cause , passed by the New York State  Senate & Assembly without a single public hearing or other input from the various Law enforcement agencies of the State of New York, and

WHEREAS,    by their own admission, many  State lawmakers did not have adequate opportunity to review the bill as presented, as the bill was shepherded through the legislative process under the guise of executive exigency,  leaving unresolved  questions about implementation and enforcement of this new law, and

WHEREAS,    This law only serves the purpose of infringing on the Constitutional rights of law abiding citizens to be able to protect themselves against criminals as well as the possible overreach of government, as intended by the Framers of the Constitution, instead of placing the focus on increasing penalties for criminals who use firearms to harm and threaten law abiding citizens and address the issues of mental illness related to violence, and

NOW THEREFORE BE IT RESOLVED, that The Town Board of the Town of Wales urgently demands that Governor Andrew M. Cuomo & the Legislative leaders suspend the New York Secure Ammunition and Firearms (S.A.F.E.) Act immediately and to engage in proper legal procedures to bring about a law that will address gun control in a constitutional and effective manner.

RESOLVED, that a certified copy of this resolution be forwarded to: Honorable Governor  Andrew M. Cuomo, Honorable  Senate Majority  Leader Dean Skelos, Majority Leader of Independent Democratic Caucus Jeff Klein, Honorable Senate Minority Leader John Sampson, Honorable Speaker of the Assembly Sheldon Silver, Honorable Leader of the Assembly Ron Canestrari, Honorable Minority Leader of the Assembly Brian Kolb. and the Western New York Delegation and Erie County Legislators

Town of Williamson resolution opposing the NY SAFE Act

Resolution passed unanimously March 12th.

Councilman Orbaker presented the following Resolution and moved its adoption. It was seconded by Councilman Bixby.

            WHEREAS, the United States Constitution second amendment, as well as New York State Civil Rights Law, guarantee our citizens the right to keep and bear arms; and

            WHEREAS, the people of the Town of Williamson derive economic and environmental benefits from all safe forms of recreation involving firearms, including hunting and target shooting; and

            WHEREAS, this legislation creates an environment in our area and across the state which is hostile to gun manufactures and those who sell and service firearms; and

            WHEREAS, requiring law-abiding gun owners to verify ownership of certain types of firearms every five years, in addition to registering them on their permits, which now also must be renewed every five years, does not increase the safety of the public and is an unnecessarily burdensome to the residents of the Town of Williamson and New York State; and

            WHEREAS, NY SAFE ACT fails to offer any meaningful solutions to gun violence and places increased burdens on our law abiding citizens; and

            WHEREAS, the manner in which this legislation was brought forward for vote in the State Legislature is deeply disturbing to the Williamson Town Board asking for a vote in only 22 minutes rather than following the Legislatures own 3 day rule and not allowing any testimony from a variety of knowledgeable people;

            NOW THEREFORE, BE IT RESOLVED, that the Williamson Town Board add its voice in opposition along with the Wayne County Legislative Board and a number of Wayne County towns to the NY SAFE Act (Chapter1 of the Laws of 2013), and request the repeal of any legislation, including the sections within the NY SAFE ACT which infringe upon the right of the people to keep and bear arms; and

            BE IT FURTHER RESOLVED, that the Williamson Town Board strongly encourages members of the New York State Legislature to hold public hearings to address the issue of gun violence in a way that will produce meaningful results; and

            BE IT FURTHER RESOLVED, the Williamson Town Board opposes the imposition of any fees on New York State gun owners to finance the new provisions of the SAFE Act and any costs associated with the implementation of the SAFE Act must be borne by the State; and

            BE IT FURTHER RESOLVED, that the Clerk of the Town of Williamson certify and communicate this resolution to New York State Governor Andrew Cuomo; US Senator Charles Schumer of New York; US Senator Kirsten Gillibrand of New York; US Congressman Daniel Maffei of New York, representing the 24th District; New York State Senator Michael Nozzolio, representing the 54th District; New York State Assembly Speaker Sheldon Silver, representing 65th District; and New York State Assemblyman Robert Oaks, representing 130th District.

Whereas, the Bath Town Board , being elected to represent the people of Bath and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and;

Whereas, the New York State Assembly and New York State Senate, being elected by the People of the State of New York, and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of New York State, and

Whereas, legislation passed in the night, 6 hours after being introduced, without any public notice or opportunity for comment by citizens effected, by New York Assembly and Senate, and infringes on the Right to Keep and Bear Arms and;

Whereas, the NY SAFE ACT bans the possession and use of firearms now employed by individual citizens of the Town of Bath for defense of Life, Liberty, Property and would ban possession and use of firearms now employed for safe forms of firearm recreation, hunting and shooting conducted within the Town of Bath, Steuben County, New York;

Whereas, the Bath Town Board believes there are many other less intrusive means available, other than rash, confusing, and inarticulately drafted firearm laws that would effectively control, manage, and reduce violence in our society, such as , mental health reforms, enforcement of existing firearms laws to the fullest extent possible, and proper psychological counseling for those in need or requesting it;

Now, therefore, it be and is hereby resolved that the Bath Town Board does hereby oppose the enactment of any legislation that would infringe upon the Right of the People to Keep and Bear Arms and consider such laws to be unnecessary and beyond lawful legislative authority granted to our State representatives, as there is no documented correlation between gun control measures and crime reduction.

Be it Resolved that the Town Board of the Town of Bath does hereby propose the repeal of the NY SAFE ACT.

Be it further Resolved that a copy of the resolution be sent to President Barack Obama, Vice President Joseph Biden, Senator Charles Schumer, Senator Kerstin Gillibrand, Governor Andrew Cuomo, Lieutenant Governor Robert Duffy, Congressman Tom Reed, Senator Thomas O’Mara, and Assemblyman Philip Palmesano.

This legislation severely impacts the possession and use of firearms now employed by residents of the Town of Royalton for defense of life, liberty and property, as well as safe forms of recreation including, but not limited to, hunting and target shooting.
