Town of Wales resolution opposing the NY SAFE act


Resolution to Repeal the New York Secure Ammunition and Firearms (S.A.F.E.) Act

WHEREAS,    We, the Town Board for The Town of Wales, Erie County in the State of New York, as representatives of our residents and as individuals, object to the infringement of the rights preserved to the citizenry by the 2nd Amendment of the Constitution of the United States of America by the governing bodies of New York State, and

WHEREAS,    On Monday January 14th, 2013 the rights of our citizens as protected  under the second Amendment of our Constitution were infringed upon without due process, and

WHEREAS,    A Gun control law (S.2230) known as New York Secure Ammunition and Firearms (S.A.F.E.) Act, was, without just cause , passed by the New York State  Senate & Assembly without a single public hearing or other input from the various Law enforcement agencies of the State of New York, and

WHEREAS,    by their own admission, many  State lawmakers did not have adequate opportunity to review the bill as presented, as the bill was shepherded through the legislative process under the guise of executive exigency,  leaving unresolved  questions about implementation and enforcement of this new law, and

WHEREAS,    This law only serves the purpose of infringing on the Constitutional rights of law abiding citizens to be able to protect themselves against criminals as well as the possible overreach of government, as intended by the Framers of the Constitution, instead of placing the focus on increasing penalties for criminals who use firearms to harm and threaten law abiding citizens and address the issues of mental illness related to violence, and

NOW THEREFORE BE IT RESOLVED, that The Town Board of the Town of Wales urgently demands that Governor Andrew M. Cuomo & the Legislative leaders suspend the New York Secure Ammunition and Firearms (S.A.F.E.) Act immediately and to engage in proper legal procedures to bring about a law that will address gun control in a constitutional and effective manner.

RESOLVED, that a certified copy of this resolution be forwarded to: Honorable Governor  Andrew M. Cuomo, Honorable  Senate Majority  Leader Dean Skelos, Majority Leader of Independent Democratic Caucus Jeff Klein, Honorable Senate Minority Leader John Sampson, Honorable Speaker of the Assembly Sheldon Silver, Honorable Leader of the Assembly Ron Canestrari, Honorable Minority Leader of the Assembly Brian Kolb. and the Western New York Delegation and Erie County Legislators
