Association of Erie County Governments resolution to amend the NY SAFE Act

WHEREAS, The Association of Erie County Governments who represents the voice of the people, is made up of 25 Towns, 16 Villages and 3 Cities that represent the County of Erie, in the State of New York with a population of approximately 1,000,000 people, and

WHEREAS, On Monday January 14th, 2013 the rights under the second Amendment of our Constitution was infringed on without due process, and

WHEREAS, The Gun Control Bill (S.2230) known as NY SAFE Act was rushed through the Senate & Assembly without a single Public hearing or input from the various Law enforcement agencies located around our State, and

WHEREAS, Even the State lawmakers did not have time to review the bill as presented leaving questions about implementation and regulation of this new law, and

WHEREAS, This law should focus on increasing penalties for criminals who use firearms to harm and threaten law abiding citizens and address the issues of mental illness related to violence, and

WHEREAS, The Association of Erie County Governments realizes that NY SAFE Act, gun control law must be repealed and replace the restrictive parts of the enacted law, and

NOW THEREFORE BE IT RESOLVED, that the Association of Erie County Governments urgently asks Governor Andrew M. Cuomo & the Legislative leaders to suspend this law as soon as possible and to look at all of the aspects of gun control using the proper legal procedure to bring about a law that will address gun control in a more logical manner, focusing on the real issues related to gun control – a law that will strengthen the effect on public safety and not infringe upon our constitutional rights.

RESOLVED, that a certified copy of this resolution be forwarded to:

Town of Union Vale resolution opposing the NY SAFE act

WHEREAS, the Right of the People to Keep and Bear Arms is guaranteed as an Individual Right under the Second Amendment to the United States Constitution of the State of New York, and;

WHEREAS, the Right of the People to Keep and Bear Arms for defense of Life, Liberty and Property is regarded as an Inalienable Right by the People of the Town of Union Vale, Dutchess County, New York, and;

WHEREAS, the People of the Town of Union Vale, Dutchess County, New York derive economic benefit from all safe forms of firearms recreation, hunting and shooting conducted within Union Vale using all types of firearms allowable under the Unites States Constitution and the Constitution of the State of New York, and;

WHEREAS, the Union Vale Town Board, being elected to represent the People of Union Vale and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and;

WHEREAS, New York State Assembly and the New York State Senate, being elected by the People of the State of New York and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and;

WHEREAS, legislation passed by the New York State Assembly and the New York State Senate infringes on the Right to Keep and Bear Arms and would ban possession and use of firearms now employed by individual citizens of the Town of Union Vale, for defense of Life, Liberty and Property and would ban possession and use of firearms now employed for the safe forms of firearms recreation, hunting and shooting conducted within the Town of Union Vale, Dutchess County, New York, and;

WHEREAS, the Union Vale Town Board believes there are many other less intrusive means available, other than rash, confusing, and inarticulately drafted firearms laws that would effectively, control, manage, and reduce violence in our society, such as, mental health reforms, anti-bullying rograms for schools, enforcement of existing firearms laws to the fullest extent possible, and proper psychological counseling for those in need or who request it;

NOW, THEREFORE, IT BE AND IS HEREBY RESOLVED that the Union Vale Town Board does hereby oppose the enactment of any legislation that would infringe upon the Right of the People to keep and bear arms and consider such laws to be unnecessary and beyond lawful legislative authority granted to our State representatives, as there is no documented correlation between gun control measures and crime reduction.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to President Barack Obama, Vice President Joseph Biden, Senator Charles Schumer, Senator Kirsten Gillibrand, Congressman Christopher Gibson, Governor Andrew Cuomo, Senator Terry Gipson and Assemblyman Kieran Lalor

WHEREAS, The Town of Colden Town Board who represents the voice of the people that reside in Colden, County of Erie, in the State of New York with a population of approximately 3,400 people, and

WHEREAS, On Monday January 14th, 2013 the rights under the second Amendment of our Constitution was infringed on without due process, and

WHEREAS, Even the State lawmakers did not have time to review the bill as presented leaving questions about implementation and regulation of this new law, and

WHEREAS, This law should focus on increasing penalties for criminals who use firearms to harm and threaten law abiding citizens and address the issues of mental illness related to violence, and

WHEREAS, The Town of Colden realizes that NY SAFE Act, gun control law must be repealed and replace the restrictive parts of the enacted law, and

NOW THEREFORE BE IT RESOLVED, that the Town of Colden urgently asks Governor Andrew M. Cuomo & the Legislative leaders to suspend this law as soon as possible and to look at all of the aspects of gun control using the proper legal procedure to bring about a law that will address gun control in a more logical manner, focusing on the real issues related to gun control – a law that will strengthen the effect on public safety and not infringe upon our constitutional rights.

RESOLUTION IN SUPPORT OF THE SECOND AMENDMENT

Motion Supervisor Sweeton, seconded Councilman Gerstner to adopt the following resolution:

WHEREAS, the Right of the People to Keep and Bear Arms is guaranteed as an Individual Right under the Second Amendment to the United States Constitution and under the Constitution of the State of New York, and;

WHEREAS, the Right of the People to Keep and Bear Arms for defense of Life, Liberty, and Property is regarded as an Inalienable Right by the People of the Town of Warwick, Orange County, New York, and;

WHEREAS, the Town Board, being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and;

WHEREAS, the New York State Assembly and the New York State Senate, being elected by the People of the State of New York and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York, and;

WHEREAS, legislation passed by the New York Assembly and Senate infringes on the Right to Keep and Bear Arms and would ban the possession and use of firearms now legally possessed by individual citizens of the Town of Warwick, for defense of Life, Liberty and Property and would ban the possession and use of firearms now legally possessed for safe forms of firearms recreation, hunting and shooting as well as hinder the Warwick Police Departments ability to ensure the safety of our residents and;

WHEREAS, this legislation was passed hastily, without adequate time for review by legislators, and public debate nor due consideration to the consequences of said legislation, and;

WHEREAS, the Town Board of the Town of Warwick believes that our State representatives should engage the public in a full, open debate that would include some provisions of the legislation as well as other methods that would effectively, control, manage, and reduce violence in our society, such as, mental health reforms, anti-bullying programs for schools, enforcement of existing firearms laws to the fullest extent possible, and proper psychological counseling for those in need or who request it;

NOW, THEREFORE IT BE AND IS HEREBY RESOLVED that the Town of Warwick Town Board does hereby oppose the hastily enacted NY SAFE act that infringes upon the Second Amendment of the US Constitution and hereby urges the Legislature to rescind this legislation which we consider to be beyond lawful legislative authority granted to our State representatives.

BE IT FURTHER RESOLVED that a copy of this resolution be sent to Senator John Bonacic and Assemblywoman Annie Rabbitt, Governor Cuomo, as well as President Barack Obama, Vice President Joseph Biden, Senator Charles Schumer, Senator Kristen Gillibrand, Congressman Sean Patrick Maloney.

Town of Montgomery resolution opposing the SAFE act

Resolution – 2nd Amendment

Supervisor Hayes – We have a Resolution in support of the 2nd Amendment. We talked about this last week and it is in the Board’s
correspondence package. I also copied the resolution that Ken Valk dropped off last week from Ulster County. That has all been copied to the Board. The two resolutions have much of the same language. This is in support of the 2nd Amendment and it really came about by the new law that was passed. Not only what it did in regards to the registering of your weapons and what they were going to outlaw, but also the fact that it was discussed all within a ½ hour.

A Motion by Councilman Dempsey, Jr., seconded by Councilman Hoyt that the Town Board of the Town of Montgomery adopts the Resolution in support of the 2nd Amendment.

Town of Concord resolution opposing the SAFE Act

Town of Concord resolution opposing the SAFE Act passed unanimously.

Resolution – Safe New York – Supervisor Eppolito asked for the Board for a motion in support of a Resolution regarding the State Law which was passed without due process.

Councilwoman King moved the adoption of Resolution 4, seconded by Councilman Salzler:

WHEREAS, the Town of Concord represents approximately 8,500 citizens in southern Erie County; and

WHEREAS, on Monday, January 14, 2013, the second amendment of our Constitution was infringed upon without due process by the Governor of New York and the State’s Legislative branches; and

WHEREAS, the Gun Control Bill (S.2230) known as NY SAFE Act was rushed through those legislative bodies and signed by Governor Cuomo without a single public hearing or any input from state law enforcement agencies; and

WHEREAS, the majority of state lawmakers did not have sufficient time to review this piece of legislation thus leaving serious questions concerning its implementation and enforcement; and

WHEREAS, the NY SAFE act does not focus on increasing penalties for criminals who utilize firearms to harm or threaten law abiding citizens, nor does it address the issue of mental illness as it relates to violence; and

THEREFORE; the Concord Town Board formally requests that NYS SAFE (S.2230) be repealed and that no new legislation be enacted until lawmakers are able to receive public input, and these Senators and Assemblymen are given sufficient time to consider the ramifications of such a law.

BE IT RESOLVED, that a certified copy of this resolution be forwarded to Governor Cuomo, Senate Majority Leader Skelos, Speaker of the Assembly Silver, and the Assembly Minority Leader Brian Kolb, and the Western New York Delegation as well as the Minority and Majority Leaders of the Erie County Legislature.

Town of DeRuyter resolution opposing NY SAFE resolution

Resolution 44 of 2013

OPPOSING THE NEW YORK SECURE AMMUNITION AND FIREARMS ENFORCEMENT ACT OF 2013 and ASSEMBLY BILL A-03908

WHEREAS, the right to bear arms is guaranteed by the Second Amendment of the U.S. Constitution, as well as the Civil Rights Law of the State of New York; and

WHEREAS, the New York State Secure Ammunition and Firearms Enforcement Act of 2013 which was rushed to passage without public comment by the New York State Senate, Assembly and Governor, will have a detrimental effect on hunters, sportsmen and legal gun owners; and

WHEREAS, Assembly Bill A03908 calls for mandatory liability insurance for all firearm owners; and

WHEREAS, these pieces of legislation impose burdensome new regulations upon law abiding gun owners and will curtail the rights of law abiding citizens of this State; and

WHEREAS, these pieces of legislation, while denying the rights of law abiding citizens, fail to address the problem of acts of violence perpetrated by criminals and those who are dangerously mentally ill; and

WHEREAS, these pieces of legislation create an environment in New York State, Madison County, and the Town of DeRuyter which is hostile to gun manufacture and ownership,

NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of DeRuyter does hereby oppose the enactment of and calls upon the New York Legislature and Governor to set aside and annul the New York State Secure Ammunition and Firearms Enforcement Act of 2013 because it fundamentally alters or abridges the right to keep and bear arms without addressing the problems of gun violence; and

BE IT FURTHER RESOLVED, that this Board hereby opposes any additional regulations and restrictions to the legal firearm owners through further legislation, such as A03908.

BE IT FURTHER RESOLVED, that certified copies of this Resolution be forwarded to Senator David J. Valesky and Assemblyman William D. Magee.
